Terms and Conditions

1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern access to and use of www.paddyteacher.com and the Paddy Teacher Thinkific school (together, the “Platform”), operated by Paddy Teacher Ltd, a company registered in Ireland (“Paddy Teacher”, “we”, “us”, “our”).

By creating an account, enrolling in a course, or making a payment through the Platform, you (“Participant”, “you”) confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Academic Integrity Policy. If you do not agree, you must not enrol in or access any course.

These Terms constitute a legally binding agreement between you and Paddy Teacher Ltd for the supply of digital professional development content and, where applicable, live webinar training.

2. Who We Are

Trading name: Paddy Teacher Ltd

Registered in: Ireland

Website: www.paddyteacher.com

Email: info@paddyteacher.com

3. Eligibility and Course Suitability

Our courses are designed for primary school teachers, educators, and related education professionals. It is your responsibility to review the published course description, learning outcomes, and target audience before enrolling. Course previews, module outlines, and sample content are made available prior to purchase specifically so that you can assess suitability before committing to buy — accordingly, dissatisfaction with course content, teaching style, or pedagogical approach after purchase is not, by itself, grounds for a refund once access has been granted (see Section 6).

You must provide accurate registration information, including your name, school, and Teaching Council registration number where applicable, as this information may be required for CPD certification purposes.

4. Course Access and Licence

Upon successful payment, you are granted a limited, non-exclusive, non-transferable, revocable licence to access the purchased course for the duration specified at the time of purchase (typically the relevant cohort period plus a defined access window thereafter). This licence is personal to you and may not be shared, resold, sublicensed, or used to provide training to third parties.

We reserve the right to suspend or terminate your access, without refund, where we reasonably believe you have breached these Terms, the Academic Integrity Policy, shared login credentials, or attempted to copy, download, or redistribute course materials in violation of Section 11.

5. Fees and Payment

All fees are displayed in euro (EUR) at the point of sale, inclusive or exclusive of VAT as applicable and as determined by your location in accordance with EU VAT OSS rules, UK VAT rules, or applicable US/Canadian sales tax rules. Payment is processed securely through Stripe via our Thinkific school. We do not store your card details.

Full payment is required at the time of enrolment unless an alternative payment arrangement (for example, an instalment plan or purchase order for institutional bookings) has been expressly agreed with us in writing in advance.

We reserve the right to amend course pricing at any time. Price changes will not affect enrolments already completed at the time of the change.

6. Cancellation, Withdrawal, and Refunds

This section sets out your cancellation rights and our refund policy. It has been structured to comply with applicable consumer protection law in Ireland, the EU, the UK, the United States, and Canada, while ensuring that Paddy Teacher can operate a sustainable small business and is not obliged to issue refunds once course value has been delivered or consumed.

6.1  Your Right to Cancel (EU, EEA, UK, and Ireland)

If you are a consumer located in the EU, EEA, or UK, you ordinarily have a 14-day statutory right to cancel a distance contract without giving a reason, under the EU Consumer Rights Directive 2011/83/EU (as implemented in Ireland by S.I. No. 484/2013) and, for UK consumers, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

However, this statutory cooling-off right does not apply to the supply of digital content which is not supplied on a tangible medium, where performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of cancellation (Article 16(m) of the Directive; Regulation 15 of the UK regulations).

At the point of checkout, you will be asked to expressly confirm that you wish course access to begin immediately, and that you acknowledge and agree that, by doing so, you lose your statutory right to cancel once you have accessed any part of the course.

Where you have not accessed any course content and contact us within 14 days of purchase, you are entitled to a full refund under this statutory right. Once you access any module, download any resource, or attend any live session, this statutory cancellation right no longer applies, and refunds are governed solely by Sections 6.3 to 6.5 below.

6.2  United States and Canadian Participants

There is no general federal statutory cooling-off period applicable to online educational course purchases in the United States or Canada. Accordingly, for participants located in the United States and Canada, all sales are final upon enrolment, subject only to the refund circumstances described in Section 6.3 and any non-excludable rights available under applicable state, provincial, or territorial consumer protection legislation, which are not affected by these Terms.

6.3  Circumstances in Which a Refund Will Be Issued

We will issue a full or partial refund, at our discretion as to form (cash refund, credit, or transfer to a future cohort), only in the following circumstances:

  • We cancel a cohort or course in its entirety before it commences, and no reasonable alternative cohort or date is offered or accepted;

  • A verified, sustained technical failure of the Platform prevents you from accessing purchased course content, this is reported to our technical support team in accordance with our published support process, and we are unable to restore or provide alternative access within a reasonable period;

  • You cancel within the 14-day statutory cooling-off window described in Section 6.1 and have not accessed any course content;

  • We are required to provide a refund by mandatory, non-excludable consumer protection law in your jurisdiction that overrides this policy.

6.4  Circumstances in Which No Refund Will Be Issued

Except as set out in Section 6.3, refunds will not be issued in circumstances including, but not limited to:

  • Change of mind after course access has commenced;

  • Failure to attend a live webinar or synchronous session, regardless of reason, where the recording or equivalent asynchronous material is made available;

  • Failure to complete course modules, assignments, or reflection tasks within the access window;

  • Dissatisfaction with content, delivery style, or pedagogical approach where course previews and outlines were available prior to purchase;

  • Withdrawal or removal from a course for breach of the Academic Integrity Policy or these Terms;

  • Failure to meet the certification criteria set out in Section 8;

  • Personal circumstances, scheduling conflicts, or changes in employment that arise after purchase;

  • Purchase made in error where the participant failed to review the published course description prior to buying;

  • Any request made outside of a reasonable timeframe following the issue first arising.

6.5  Discretionary Goodwill Consideration

Outside of the circumstances set out in Section 6.3, Paddy Teacher may, at its sole and absolute discretion, consider a partial refund, credit, or transfer to a future cohort on a case-by-case goodwill basis — for example, in cases of serious documented illness or bereavement. Any such goodwill gesture is offered without admission of obligation, does not set a precedent, and does not entitle any other participant to equivalent treatment. We reserve the right to decline any such request without providing a reason.

6.6  Chargebacks and Payment Disputes

If you initiate a chargeback, dispute, or reversal with your card issuer or payment provider in relation to a purchase where no refund is due under this policy, we reserve the right to:

  • Immediately suspend or permanently revoke your access to all course content and any issued certificates;

  • Submit evidence of your acceptance of these Terms, course access logs, login activity, and content consumption records to the payment provider or card issuer in defence of the charge;

  • Recover any costs, fees, or losses reasonably incurred as a result of an unfounded chargeback, to the extent permitted by law;

  • Decline future enrolment requests from the participant or associated payment method.

We keep detailed records of course access, login activity, and content engagement for this purpose and to support the fair resolution of any payment dispute.

7. Cohort Scheduling, Postponement, and Course Changes

Course cohorts run on published start and end dates, with a live webinar delivered on a specified date within each cohort. We reserve the right to reschedule a live webinar, postpone a cohort start date, or make reasonable adjustments to course content and structure where necessary, provided that the overall value and learning outcomes of the course are maintained. Where such a change materially affects your ability to participate, you may request a transfer to an alternative cohort at no additional cost.

Each cohort is capped at a maximum number of participants as published at the time of enrolment. Enrolment is confirmed only upon receipt of full payment.

8. Certificates of Completion

Certificates of attendance and course completion are issued only where a participant has satisfied all requirements set out in our Quality Assurance Manual, including minimum attendance at live training sessions, completion of all sequential self-paced modules, satisfactory submission of all required assessment and reflection tasks, and compliance with the Academic Integrity Policy and participation requirements.

Purchase of a course does not, by itself, entitle a participant to a certificate. Certification eligibility is confirmed only after our review of attendance and completion records. Failure to meet certification criteria is not grounds for a refund (see Section 6.4).

9. Participant Conduct and Academic Integrity

All participants must comply with our Academic Integrity Policy, provided at course commencement and forming part of these Terms by reference. This includes the requirement that all submitted work is the participant’s own and reflects genuine engagement with their own teaching context. Breach of the Academic Integrity Policy may result in withdrawal from the course, revocation of certification, and forfeiture of any right to a refund.

Participants are expected to engage respectfully with course tutors and fellow participants in any discussion forums or live sessions. We reserve the right to remove any participant from the Platform, without refund, for abusive, threatening, or disruptive conduct towards staff or other participants.

10. Complaints Procedure

Paddy Teacher is committed to addressing concerns fairly, transparently, and in a timely manner. If you have a concern about your course experience, please raise it informally in the first instance by contacting your Course Tutor by email.

If the matter is not resolved informally, you may submit a formal written complaint to info@paddyteacher.com within 10 working days of the issue arising. Your complaint will be acknowledged within 5 working days and investigated, in the ordinary course, within 15 working days. All complaints are handled confidentially and in accordance with GDPR and the Data Protection Acts 1988–2018.

A complaint raised and resolved through this procedure does not automatically entitle a participant to a refund; any resulting refund remains subject to Section 6 of these Terms.

11. Intellectual Property

All course materials, resources, recordings, frameworks, assessments, and methodologies made available through the Platform are the intellectual property of Paddy Teacher Ltd, or are licensed to us, unless otherwise stated. Materials are provided solely for your personal professional development and may not be copied, reproduced, distributed, publicly displayed, or used to train, brief, or instruct others without our prior written consent.

Our Platform incorporates technical protection measures, including restrictions on copying, downloading, and content sharing. Circumventing these measures, or reproducing course materials outside the Platform, constitutes a material breach of these Terms and may result in immediate termination of access without refund and further legal action.

12. Data Protection

Our collection and use of your personal data is governed by our Privacy Policy, available at www.paddyteacher.com, which forms part of these Terms. By enrolling in a course, you acknowledge that your data will be processed by us and by our service providers (including Thinkific, Stripe, and Mailchimp) as described in that Policy.

13. Disclaimers and Limitation of Liability

Our courses are provided for professional development purposes. While we take care to ensure content is accurate, evidence-informed, and aligned with relevant curriculum frameworks, we do not guarantee any specific pupil outcome, assessment result, or career outcome arising from your participation.

To the fullest extent permitted by applicable law, Paddy Teacher’s total liability to you in connection with these Terms or your use of the Platform shall not exceed the total fees paid by you for the course giving rise to the claim. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited.

We are not liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including those described in Section 14.

14. Force Majeure

We shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from events outside our reasonable control, including but not limited to internet or platform outages caused by third-party providers, power failures, extreme weather, illness of key personnel, or other events of force majeure. In such circumstances, we will take reasonable steps to reschedule affected sessions or extend access windows in lieu of a refund.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Ireland. Subject to the paragraph below, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer resident in the EU, UK, USA, or Canada, nothing in these Terms deprives you of the protection afforded by mandatory provisions of the consumer protection law of the country in which you are resident, where such law would otherwise apply, and you may in some circumstances be entitled to bring proceedings in the courts of your own country of residence.

16. Severability

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be notified to enrolled participants by email and/or a notice on our website. Changes will not apply retroactively to a course purchase already completed prior to the change taking effect. Continued use of the Platform following any update constitutes acceptance of the revised Terms.
